Terms of Service

1. Agreement

These Terms of Service (“Terms”) govern your access to and use of the websites, applications, and services offered by Oops Lab LLC (“Oops Lab”, “we”, “us”), including but not limited to oopslab.ai, crimescore.io, the Mousey mobile application, and any other product we publish under the Oops Lab brand (collectively, the “Services”).

By accessing or using the Services, you agree to these Terms. If you do not agree, do not use the Services. If you are using the Services on behalf of an organization, you represent that you have authority to bind that organization to these Terms.

2. Eligibility and accounts

You must be at least 13 years old (or older if your country’s law requires) to use the Services. Our products are not designed for or directed to children under 13.

If you create an account, you are responsible for the security of your credentials and for any activity under your account. Please notify us at oopslabai@gmail.com immediately if you suspect unauthorized access.

3. Acceptable use

You agree not to:

  • Use the Services in violation of any applicable law or regulation.
  • Reverse engineer, decompile, or attempt to extract source code, except where law expressly permits it.
  • Resell, redistribute, or sublicense the Services or any data we provide except as expressly authorized in a written agreement.
  • Probe, scan, or test the vulnerability of any system or network without our prior written consent.
  • Use the Services to harass, defraud, or harm others, or to violate the privacy or rights of any third party.
  • Submit content that is unlawful, infringing, malicious, or otherwise objectionable.
  • Interfere with or disrupt the operation of the Services or the servers and networks behind them.

We may suspend or terminate access without notice if we believe you have violated these Terms or if your use of the Services creates a security or legal risk.

4. Subscriptions and payment

Some Services are offered on a paid subscription basis. Payments are processed by Stripe, Inc. By providing payment information, you authorize us (and Stripe) to charge the applicable fees. Subscriptions renew automatically until canceled. You can cancel at any time from your account settings or by emailing oopslabai@gmail.com; cancellation takes effect at the end of the then-current billing period.

Fees are non-refundable except where required by law or expressly stated otherwise in our billing terms.

5. Hardware (Mousey)

If you purchase Oops Lab hardware, including a Mousey device, the hardware is sold to you subject to a limited manufacturer warranty for defects in materials and workmanship for a period of one (1) year from the date of delivery. This warranty does not cover damage caused by misuse, modification, accident, or normal wear. To make a warranty claim, email oopslabai@gmail.com.

6. Intellectual property

Oops Lab and its licensors retain all right, title, and interest in and to the Services, including all software, content, designs, trademarks, and documentation. We grant you a limited, revocable, non-exclusive, non-transferable license to use the Services in accordance with these Terms.

You retain ownership of any content or data you submit through the Services. You grant us a limited license to host, process, and transmit that content as necessary to provide the Services to you.

7. Third-party services

The Services may interoperate with or rely on third-party providers (such as Stripe and cloud infrastructure vendors). We are not responsible for the operation, terms, or content of those third parties, and your use of their services is governed by their own terms and policies.

8. Disclaimers

THE SERVICES ARE PROVIDED ON AN “AS IS” AND “AS AVAILABLE” BASIS. TO THE MAXIMUM EXTENT PERMITTED BY LAW, OOPS LAB DISCLAIMS ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING WITHOUT LIMITATION ANY WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, AND ANY WARRANTIES ARISING FROM COURSE OF DEALING OR USAGE OF TRADE. WE DO NOT WARRANT THAT THE SERVICES WILL BE ERROR-FREE OR UNINTERRUPTED, OR THAT ANY DATA WILL BE ACCURATE, COMPLETE, OR CURRENT.

Information returned by Oops Lab APIs (including risk scores, location data, and similar outputs) is provided for informational purposes. You are responsible for evaluating whether the data is appropriate for your use case and for any decisions you make based on it.

9. Limitation of liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, OOPS LAB AND ITS OFFICERS, EMPLOYEES, AND CONTRACTORS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR FOR ANY LOSS OF PROFITS, REVENUE, DATA, OR GOODWILL, ARISING FROM YOUR USE OF THE SERVICES.

OUR TOTAL CUMULATIVE LIABILITY FOR ANY CLAIM ARISING OUT OF OR RELATING TO THE SERVICES IS LIMITED TO THE GREATER OF (A) THE AMOUNTS YOU PAID US IN THE TWELVE (12) MONTHS PRECEDING THE EVENT GIVING RISE TO THE CLAIM, OR (B) ONE HUNDRED U.S. DOLLARS (US$100).

Some jurisdictions do not allow the exclusion or limitation of certain damages, in which case our liability is limited to the maximum extent permitted by law.

10. Indemnification

You agree to defend, indemnify, and hold harmless Oops Lab from any third-party claims, damages, liabilities, and expenses (including reasonable legal fees) arising out of (a) your violation of these Terms, (b) your misuse of the Services, or (c) your violation of any law or third-party right.

11. Termination

You may stop using the Services at any time. We may suspend or terminate your access if you breach these Terms or if continuing to provide the Services becomes commercially or legally impractical. Upon termination, the rights granted to you under these Terms end and we may delete data associated with your account in accordance with our Privacy Policy.

12. Governing law and disputes

These Terms are governed by the laws of the State of New York, without regard to conflict of law principles. The exclusive venue for any dispute is the state and federal courts located in New York County, New York, and you consent to the personal jurisdiction of those courts.

13. Changes

We may update these Terms from time to time. When we make material changes we will revise the Last updated date and, where appropriate, give you notice through the app or by email. Your continued use of the Services after a change constitutes acceptance of the updated Terms.
